After last month’s frustrating public hearing at the NYC Board of Standards & Appeals (BSA), the writing may be on the wall.
 
On January 10, 2017, in front of a packed room of neighbors opposing Congregation Shearith Israel’s attempt to push through a moving-target plan to build luxury condominiums on the site of its former community house, BSA Chair Margery Perlmutter maintained that it’s “typical” that “we never see fully developed design drawings”.  The BSA – the city agency tasked with determining whether property owners need exemption from zoning laws that apply to everyone else, and that they receive only the minimum variance necessary to afford hardship relief  – makes its decisions based only on as much information that applicants and their lobbyists choose to give them.
THIS IS GOVERNMENT IN THE DARK!
 
This vote comes at a time when the BSA process is under scrutiny (yet again) for its routine favoritism towards applicants.  For example, one pending City Council bill calls for a $25,000 fine against any “person who makes a materially false statement or causes a materially false statement to be made in connection with a zoning application.”
